Description
HELD. - Serving 128 days jail time before trial did not violate Hoyts right to a speedy trial. Failure to specify certain details of the charge did not deny Hoyt his right to due process and equal protection. Seating the child victim out of Hoyts line of vision did not infringe on his right of confrontation. The trial court did not abuse its discretion in permitting a companion to accompany the child victim at the witness stand. Rimmasch case did not apply retroactively. Expert testimony on the victims credibility was not plain error, for lack of a showing of prejudice. Hoyt was not deprived of the effective assistance of counsel, absent a showing that the outcome would have been more favorable.
